Acceptance of Terms

By accessing the Migraciones.co website (https://migraciones.co) or using any of our immigration advisory services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. These Terms constitute a legally binding agreement between you (“Client”, “you”) and Migraciones.co (“we”, “us”, “the Company”).

If you do not agree with any part of these Terms, please do not use our website or services. We reserve the right to modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

Description of Services

Migraciones.co provides professional immigration advisory services to individuals and companies navigating the Colombian visa and immigration system. Our services include, but are not limited to:

Preparation and review of Colombian visa applications (Types V, M, and R)
Document guidance, checklist preparation, and referrals to certified translators or apostille services
Immigration compliance consulting for companies (including SIRE — Sistema de Información de Registro de Extranjeros)
Advisory on residency, naturalization, and Colombian nationality processes
General migration consulting for individuals relocating to or within Colombia

Important disclaimer: Migraciones.co is an immigration advisory firm. We are not a law firm, and our advisors are not licensed attorneys (abogados) unless explicitly stated in your engagement agreement. Our services consist of immigration advisory and document support — not legal representation before courts. For matters requiring legal representation, we will refer you to a qualified Colombian attorney.

Service Fees and Payment

Our fees are determined on a per-engagement basis and are agreed upon in writing before any service begins. By proceeding with a service, you confirm your acceptance of the quoted fee.

Consultation fees: Fees for initial consultations are non-refundable once the consultation has taken place, regardless of the outcome or whether you proceed with additional services.
Document preparation fees: Fees for document preparation or visa application support may be partially refundable if service has not yet commenced. Once work has begun, refunds will be assessed on a pro-rata basis at our discretion.
Government fees: Visa application fees, government filing fees, apostille costs, translation fees, and other third-party charges are not included in our advisory fees and are the client’s sole responsibility.
Payment terms: Unless otherwise agreed in writing, payment is due before services commence. We accept payment by bank transfer and other methods confirmed at the time of engagement.

Client Obligations

To allow us to provide effective advisory services, you agree to the following obligations:

Accuracy of information: You must provide complete, accurate, and truthful information and documentation. Migraciones.co is not responsible for visa denials, processing delays, or legal consequences arising from inaccurate, incomplete, or fraudulent information provided by the client.
Timely submission: You must provide requested documents and complete required actions within the timeframes communicated by our team. Delays on the client’s part may affect processing timelines and outcomes.
Payment of agreed fees: You must pay all agreed fees according to the terms established at the start of the engagement.
Legal compliance: You must comply with all applicable Colombian immigration laws, regulations, and visa conditions. It is your responsibility to maintain valid immigration status and comply with the conditions of any visa issued to you.
Communication: You must maintain accessible and responsive communication throughout your engagement. We will not be held responsible for missed deadlines caused by failure to respond to our communications.

Limitations of Liability

Migraciones.co provides expert advisory services to maximize the likelihood of a successful visa outcome, but we cannot guarantee results. The following limitations apply:

No guarantee of visa approval: The final decision on all visa applications rests exclusively with Colombian government authorities, including the Cancillería de Colombia and Migración Colombia. We do not guarantee, and cannot guarantee, visa approval in any specific case.
Government processing times: We are not liable for delays caused by government processing timelines, administrative backlogs, system outages, or other delays beyond our control.
Regulatory changes: Colombian immigration law and visa regulations may change without notice. We are not liable for outcomes resulting from regulatory changes that occur after advisory services have been rendered.
Third-party services: We are not responsible for errors, delays, or failures related to apostille services, certified translations, courier services, notarial services, or other third-party processes required as part of a visa application.
Visa denials: We are not liable for visa denials resulting from factors outside our control, including client-provided information, the client’s immigration history, security considerations, or discretionary authority exercised by immigration officials.
Limitation of damages: To the maximum extent permitted by Colombian law, our total liability to you for any claim arising from our services shall not exceed the fees paid by you for the specific service giving rise to the claim.

Intellectual Property

All content published on https://migraciones.co, including but not limited to written text, blog articles, visa guides, checklists, templates, images, graphics, and the overall site design, is the exclusive property of Migraciones.co and is protected under Colombian Law 23 of 1982 on Copyright and applicable international intellectual property treaties.

You may not reproduce, distribute, publish, transmit, display, modify, or create derivative works from any content on this website without the prior written permission of Migraciones.co. Linking to our publicly accessible pages is permitted provided it is done in a way that is fair and does not damage our reputation.

Any content you submit to us (e.g., documents, information) remains your property. By submitting it, you grant us a limited license to use it solely for the purpose of delivering the agreed services.

Privacy and Personal Data

The collection and use of your personal data in connection with our services is governed by our Privacy Policy, available at https://migraciones.co/en/privacy-policy. By using our services, you agree to the collection and use of your data as described in that policy.

We handle all personal data in compliance with Colombian Law 1581 of 2012 on the Protection of Personal Data (Habeas Data). We do not sell your personal data to third parties.

Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict of law principles.

In the event of any dispute, controversy, or claim arising from or related to these Terms or our services, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be submitted to mediation in Medellín, Antioquia, Colombia, before an accredited mediator.

If mediation is unsuccessful, the parties submit to the exclusive jurisdiction of the competent civil courts of Medellín, Antioquia, Colombia.

Modifications to These Terms

We reserve the right to modify, update, or replace these Terms of Service at any time at our sole discretion. When we make changes, we will update the “Effective as of” date at the top of this page.

Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review this page periodically to stay informed of any updates.
